These Terms of Service (“Terms”) govern your use of TattooTumblers.com and purchases made from Kivvy Enterprises LLC, doing business as Tattoo Tumblers (“Tattoo Tumblers,” “we,” “us,” or “our”).

By accessing our website, placing an order, or purchasing a product from Tattoo Tumblers, you agree to these Terms. If you do not agree with these Terms, please do not use our website or place an order.

1. Online Store Terms

You must be legally capable of entering into a binding agreement to purchase products from Tattoo Tumblers.

You may not use our products, website, artwork, photographs, or services for any unlawful or unauthorized purpose. You may not attempt to interfere with the operation or security of TattooTumblers.com.

2. Products and Availability

Tattoo Tumblers specializes in laser-engraved products featuring original tattoo artwork, custom designs, and other approved artwork.

We make reasonable efforts to accurately display product colors, designs, dimensions, engraving, and other characteristics. However, actual appearance may vary slightly due to differences in screens, lighting, product materials, manufacturing, engraving, and the rainbow finishes used on certain products.

Because products may be individually engraved, minor variations in engraving placement, color, appearance, and finish are normal and are not necessarily defects.

All products are subject to availability. We reserve the right to discontinue or modify products at any time.

3. Prices and Payment

Prices are displayed in U.S. dollars unless otherwise stated.

We reserve the right to change product prices at any time. Price changes will not affect orders that have already been accepted and paid for, except where permitted by law.

Applicable sales taxes, shipping charges, and other charges will be displayed during checkout when applicable.

Payment must be successfully authorized before an order can be processed.

4. Orders

Submitting an order does not guarantee acceptance of the order.

Tattoo Tumblers reserves the right to refuse or cancel an order when reasonably necessary, including because of:

  • Product availability;
  • Pricing, listing, or website errors;
  • Suspected fraud or unauthorized transactions;
  • Problems with customer-supplied artwork;
  • Intellectual property concerns; or
  • Requests that we determine we cannot or should not fulfill.

If we cancel an order after payment has been collected, we will refund the amount paid for the canceled portion of the order.

5. Custom and Personalized Orders

Customers are responsible for carefully reviewing all information submitted for custom or personalized products, including names, dates, spelling, wording, design selections, colors, and other personalization instructions.

Tattoo Tumblers is not responsible for errors resulting from incorrect information submitted by the customer.

We reserve the right to decline any custom engraving request at our discretion, including requests involving material that we reasonably believe may violate applicable law or another person’s intellectual property rights.

6. Customer-Supplied Artwork

By submitting photographs, artwork, logos, graphics, text, or other material to Tattoo Tumblers for use on a custom product, you represent that you either:

  1. Own the applicable rights to the material; or
  2. Have obtained the permission or authorization necessary for Tattoo Tumblers to reproduce the material for your requested product.

You grant Tattoo Tumblers a limited license to use, reproduce, resize, crop, convert, adjust, or otherwise process the submitted material as reasonably necessary to produce and fulfill your order.

Submitting artwork to Tattoo Tumblers does not transfer ownership of that artwork to Tattoo Tumblers.

We reserve the right to request evidence of authorization or decline an order if we have concerns about the customer’s right to use submitted material.

7. Copyrighted and Trademarked Material

Tattoo Tumblers does not knowingly reproduce copyrighted or trademarked material without appropriate authorization.

Customers may not submit material for custom engraving when they do not own the material or have permission or other legal authority to use it.

The availability of a custom engraving service does not constitute permission to reproduce copyrighted characters, logos, photographs, artwork, trademarks, or other protected material.

8. Tattoo Artist Artwork

Tattoo Tumblers works with independent tattoo artists whose original artwork may appear on products offered through our website.

Unless otherwise expressly stated, the applicable artist retains their rights to their original artwork.

Purchasing a product containing an artist’s artwork gives the customer ownership of the physical product purchased. It does not transfer copyright, reproduction rights, licensing rights, merchandising rights, or commercial-use rights in the artwork.

Artist artwork may not be copied, traced, reproduced, scanned, extracted, modified, redistributed, or used to manufacture or sell other products without authorization from the applicable rights holder.

9. Intellectual Property

Unless otherwise stated, TattooTumblers.com and its original website content—including the Tattoo Tumblers name and branding, photographs, graphics, product descriptions, website content, and other materials—are owned by or licensed to Kivvy Enterprises LLC.

Nothing contained on this website grants permission to use Tattoo Tumblers intellectual property or participating artists’ intellectual property except as expressly authorized.

10. Shipping

Tattoo Tumblers ships orders exclusively through the United States Postal Service (USPS) and currently ships within the United States only.

Most orders are processed within approximately 3 business days. Processing time is separate from USPS transit time.

USPS delivery estimates are estimates and are not guaranteed by Tattoo Tumblers.

Customers are responsible for providing an accurate and complete shipping address.

Additional terms concerning shipping delays, lost packages, damaged shipments, incorrect addresses, and packages marked delivered are contained in our Shipping Policy, which is incorporated into these Terms.

11. Damaged or Incorrect Orders

If an order arrives damaged, defective, incorrect, or contains an engraving error caused by Tattoo Tumblers, the customer must contact us within 7 days of the delivery date shown by USPS tracking.

Customers may be required to provide their order number and photographs of the product and shipping packaging.

After reviewing the issue, Tattoo Tumblers will determine the appropriate resolution, which may include replacement or refund.

Customers should retain damaged products and their original packaging until the matter has been resolved.

12. Returns and Exchanges

Tattoo Tumblers does not accept exchanges.

Customers should carefully review product selections and personalization information before completing an order.

Custom and personalized products cannot be exchanged because of customer preference, change of mind, or errors in information supplied by the customer.

Damaged, defective, incorrect, or incorrectly engraved products resulting from an error by Tattoo Tumblers will be addressed according to our applicable policies.

13. Cancellations and Order Changes

Because products may be prepared or engraved specifically for an order, requests to cancel or modify an order should be submitted as soon as possible.

We cannot guarantee that an order can be changed or canceled after processing or engraving has begun.

Once a customized or personalized product has entered production, cancellation may not be available except where required by applicable law.

14. Website Accuracy

We make reasonable efforts to ensure that information on TattooTumblers.com is accurate. However, typographical errors, inaccurate descriptions, incorrect prices, inventory errors, or other mistakes may occasionally occur.

We reserve the right to correct errors and update information.

If an error materially affects an order you have already placed, we may contact you to provide available options or cancel and refund the affected order as appropriate.

15. Prohibited Uses

You may not use TattooTumblers.com to engage in unlawful activity, commit fraud, interfere with website security or operation, attempt unauthorized access, distribute malicious software, impersonate another person, or violate another person’s intellectual property rights.

You may not systematically scrape, copy, download, reproduce, or commercially exploit our website content, product photographs, or artist artwork without authorization.

16. Third-Party Services and Links

TattooTumblers.com may use or provide access to third-party services, payment processors, social media platforms, or external websites.

Those services are operated independently and may have their own terms and privacy policies. Tattoo Tumblers is not responsible for the content, availability, security, or practices of third-party websites or services except to the extent required by applicable law.

17. Disclaimer of Warranties

To the fullest extent permitted by applicable law, TattooTumblers.com and its website content are provided on an “as is” and “as available” basis.

Tattoo Tumblers does not guarantee that the website will always operate without interruption or error.

Nothing in these Terms excludes warranties, protections, or other consumer rights that cannot lawfully be excluded.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Kivvy Enterprises LLC, doing business as Tattoo Tumblers, will not be liable for indirect, incidental, special, or consequential damages arising from the use of our website or products.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.

19. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Kivvy Enterprises LLC and Tattoo Tumblers from third-party claims, damages, liabilities, and reasonable expenses resulting from material you submit for custom production when you did not have the rights or authorization necessary to use that material.

This provision does not limit any rights or remedies available to consumers under applicable law.

20. Privacy

Personal information collected through TattooTumblers.com is handled according to our Privacy Policy.

By using the website, you acknowledge that information necessary to process and fulfill your order may be collected and processed as described in that policy.

21. Governing Law

These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law principles, except where applicable federal law or another jurisdiction’s mandatory consumer-protection laws require otherwise.

22. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

23. Changes to These Terms

Tattoo Tumblers may update these Terms periodically to reflect changes to our business, website, products, or legal requirements.

Revised Terms become effective when posted on TattooTumblers.com unless otherwise stated. The date at the top of this page identifies the most recent revision.

This version is designed to work alongside the Shipping Policy, no-exchange policy, and Legal Notice we just created rather than contradicting them. I also included specific protection concerning customer-supplied artwork and your tattoo artists’ intellectual property, which is particularly important for Tattoo Tumblers’ business model.

One remaining policy I’d strongly recommend before considering the website policies complete is a Privacy Policy. It should be tailored to the information your store actually collects and the services you use rather than using a generic privacy-policy template.
